Full Gift Card Terms and Conditions

As of 11.13.2025

Card Terms:

These terms and conditions (“Terms”) govern your Hotels.com gift card (“Gift Card”) which is usable in Canada at ca.hotels.com. The Gift Card is issued by CARDCO CXXXIX, Inc. (“Card Issuer” or “we” or “us”). These Terms constitute a legally binding agreement between Card Issuer and you as the cardholder (“you” or “your”). Your purchase, use, or acceptance of the Gift Card constitutes your agreement to these Terms. Important: Please read the Terms below carefully as they include important information regarding the Gift Card and limitations regarding its use. If you do not agree with any of the Terms do not purchase or accept a Gift Card.

Language

These Terms are available in both French and English language versions. The French version can be accessed by clicking here. You hereby confirm that you have requested that these Terms and all related documents be drafted in English, that you have been provided with a French language version of these Terms and that you have agreed to be bound by the English language version of these Terms.

Gift Card Issuer and Sole Obligor

CARDCO CXXXIX, Inc. is the sole card issuer and sole obligor to you, the Gift Card owner. Hotels.com, Expedia, Inc., and Expedia Inc.’s subsidiaries and affiliates are not the Card Issuer or the obligors under these Terms; they hold no obligation to you for the Gift Card. Card Issuer may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not Card Issuer, will be sole obligor to Gift Card owner.

Gift Card Purchases

Gift Cards may be purchased online at various outlets (each a “Purchase Site”). Online purchases (including delivery fees, if any) will be governed by purchase and delivery terms specified on the Purchase Site; those terms are separate from these Terms. Cards may also be purchased at select retailers. Gift Cards purchased in Canada will be denominated in Canadian dollars.  Unless a lower amount is specified at purchase, the maximum balance amount for a Gift Card is $1750 CAD. No single individual may purchase Gift Cards with a total value of $10,000 CAD in any given day.  A Gift Card will not be valid unless and until it is properly acquired and activated.  A Gift Card also will not be valid if obtained by you from unauthorized sellers or resellers including from Internet auction sites.  Once purchased, the Gift Card will not be reloadable.

Gift Card Purchase Warnings

Gift cards are frequently targeted by scammers. Don’t purchase a Gift Card unless you’re buying it as a gift or for your own use—and never buy one to make a payment at someone else’s direction. For more about gift card fraud, visit stopgiftcardscams.com.

Tampering is also a risk. Fraudsters can remove cards from retail displays, steal the card numbers and PIN, reseal the packaging, and return the card to the rack—then drain the balance once it’s activated. Before purchasing, inspect the card and its packaging carefully. If anything looks removed, ripped, damaged, or tampered with, don’t buy it.

As a part of our consumer fraud prevention program, Card Issuer asks that consumers take a moment to review Card Issuer’s fraud notices prior to purchase. You do not want to be caught in a fraud scam. To the extent permitted by law, the Card Issuer is not responsible for third-party fraud or unauthorized conduct related to any Gift Card.

Two warning signs about gift card scams, urging shoppers to check packaging and never use cards for payment.

About the Gift Card

Your Gift Card is a closed-loop instrument, which means it is only redeemable or usable for Eligible Purchases made online at the Hotels.com Canada website or mobile application (the “Hotels Platform”).  Your Gift Card is a limited-value and limited-use card. It is not a debit or credit card, an asset account, a deposit account or linked to a deposit account.  It is not a bank issued card or subject to overdraft protection. You understand that the balance on the Gift Card is not insured by Canada Deposit Insurance Corporation or any other government deposit insurer or agency.  It does not bear interest, and it does not constitute evidence of indebtedness or liability by us to you, except to honour transactions made using the Gift Card in accordance with these Terms.

Gift Card Redemptions

Your Gift Card is usable up to its balance at the Hotels Platform to pay for eligible Pay Now hotel bookings (the “Eligible Purchases”). Pay Now bookings are those paid to the Hotels Platform at the time of booking. See limitations on use below.  If you do not see the ability to apply a Gift Card on the checkout page, that is an indicator that the booking is not an Eligible Purchase. All bookings and purchases made through the Hotels Platform are subject to the Hotels.com Platform’s standard terms and conditions which are separate from these Terms. They can be found here.

Limitations on Use

Your Gift Card may be redeemed only at the Hotels Platform. Your Gift Card may not be redeemed over the phone, live chat or other customer support channels. Your Gift Card may be used only for Eligible Purchases as described above. Your Gift Card is not usable at hotel locations, for Pay Later booking options, for bookings charged by the hotel, for existing bookings, for bookings made through the Groups and Meetings tab, for payment on any credit account, or for flights, activities (Things to do), car rentals, cruises, package bookings or services other than eligible Pay Now hotel bookings.  Your Gift Card balance may not be used to pay for existing bookings or toward charges for changes to existing bookings. It cannot be used in any illegal transaction. It may not be used to purchase other Gift Cards. It is not usable with loyalty rewards unless specified in the loyalty rewards program. Bookings are subject to Hotels.com’s terms and cancellation/refund policies. Only one card is usable per booking, but multiple cards may be combined into one card up to a maximum balance of $1750 CAD; visit balance services at ca.hotels.com/lp/b/giftcards for instructions. Your Gift Card may not be refunded, returned, or redeemed for cash, except to the extent required by law; provided, however, that if you are a resident of Quebec, we will refund you for any unused balance of $5 CAD or less.

Resale is Prohibited

You may not sell your Gift Card or otherwise barter or exchange the Gift Card for value. However, consistent with its intended purpose you may give a Gift Card to another person for no monetary consideration as a gift.

No Expirations or Fees Against the Card Balance

Your Gift Card does not expire. Your Gift Card is not subject to any purchase or use fees assessed against the balance of the Gift Card.

Risk of Loss

Card Issuer shall not be responsible for Gift Cards that are lost, damaged, stolen, destroyed, or used without your permission. Safeguard your Gift Card. You are responsible for the transactions using your Gift Card, whether authorized or unauthorized. You should treat your Gift Card like you treat cash. Gift Cards will not be replaced if lost, damaged, stolen, destroyed, or used without your permission.

Fraud

Card Issuer reserves the right to assert all available remedies in the event of suspected abuse or fraud regarding your Gift Card or in the event of a disputed credit or payment card charge or dishonored check at the time of card purchase. Such remedies shall include, without limitation, the blocking or freezing by the Card Issuer of a Gift Card from use or the refusal by the Card Issuer to issue or honor a Gift Card. Such remedies also shall include the right of Hotels.com to cancel bookings made with a Gift Card without any refund in the event a Gift Card is obtained by theft or fraud (including suspected theft or fraud).

Change in Terms

DOES NOT APPLY IN QUEBEC OR ONTARIO. Card Issuer reserves the right, to the extent permitted by law, to modify these Terms at any time in its discretion for the limited purposes (a) to modify the scope and nature of Eligible Purchases which may change from time to time, (b) to clarify the scope and nature of limitations on use; (c) to describe courses of action in the event the Gift Card Program is terminated, (d) to clarify existing terms and conditions, such as adding purchase methods or in respect of our responsibilities or obligations under these Terms or your responsibilities under these Terms, or (e) to address changes in information such as links; provided, however, that changes shall not include (i) changes that are adverse to the consumer with respect to existing cards at the time of the change, (ii) changes adding an expiration date, (iii) changes applying new fees regarding the use or non-use of the gift cards, or (iv) a change to this Change in Terms clause (collectively, “Changes”). These changes will be made at mycardterms.com/hotels-canada. Notice of Changes will be provided at the Cardholder Notices tab on mycardterms.com/hotels-canada and will be effective on the effective date specified in the notice.  The most current version of these Terms will be available on the website reserved for such and will supersede all previous versions of these Terms, except as otherwise specified. Your continued access to, or use of the Gift Card following any such Changes confirms your acceptance of these Terms, as amended by those Changes. If you do not agree to these Terms or any Changes made to these Terms, you must stop accessing and using the Gift Card.

APPLIES IN QUEBEC AND ONTARIO. Despite any other section that refers to our right to change or modify these Terms, if you are a resident of Quebec or Ontario, we reserve the right to make Changes to the Terms from time to time but no more than once every six (6) months. If we make Changes to the Terms, in addition to posting the amended terms on [mycardterms.com/hotels-canada], we will also provide you thirty (30) days’ advance notice of such Changes in accordance with applicable law (“Notice”). Upon receiving the Notice, you may refuse the Changes and cancel these Terms by sending us a notice to that effect as indicated in the Notice. If you do not notify us within that time, the Changes will take effect on the date indicated in the Notice.  In that case, you will be deemed to agree to the Changes which will apply to all access to and use of the Gift Cards thereafter and will become part of these Terms.

For Quebec residents only, if the amended Terms entail an increase in your obligations or a reduction in Card Issuer’s obligations, you may send us a notice within thirty (30) days after the amended Terms come into force to indicate your refusal of the amended Terms and to request the termination of the Terms without cost or penalty.

Survival of Terms

Should the Terms, or any part thereof, be determined by any court, tribunal, arbitrator, or agency of competent jurisdiction to be unenforceable, void, or voidable, or should any court, tribunal, arbitrator, or agency of competent jurisdiction refuse or decline to enforce these Terms or any part thereof, the remainder of these Terms and all parts of it shall remain in effect, valid, and enforceable.

Governing Law

These Terms and your Gift Card shall be governed by the laws of the Province of British Colombia and the federal laws of Canada applicable therein, except if you reside in the province of Quebec, in which case, the laws of the Province of Quebec, Canada shall govern these Terms.

Gift Card Program Termination

In the event the Gift Card program is terminated, instructions to cardholders will be provided by notice given in accordance with these Terms and applicable law.

Notices to Cardholder

You agree that, to the extent permitted by applicable law, we may provide notice to you, including disclosures and amendments to the Terms, by electronic means including notice posted on this site at the Cardholder Notices tab.
