Card Issuer

Your Gift Card Issuer

CIMI2508, Inc. or its affiliate (the “Card Issuer”) is the issuer of the Gift Cards in the PopUp Bagels Gift Card program.  As the Card Issuer, CIMI2508 is the sole obligor to the card owners.  Pursuant to a contract between the Card Issuer and Wolfe Merchant Solutions the Gift Cards may be sold by PopUp Bagels in its role as a card seller, and the Gift Cards will be usable by the card owners to purchase goods and/or services from PopUp Bagels in PopUp Bagels’s role as a card redeemer. PopUp Bagels is not, however, the issuer of the Gift Card and is not an obligor to the card owner. Your sole contractual party for the Gift Card is the Card Issuer, and you have no claim in respect of the Gift Card against PopUp Bagels.

Card Issuer may assign its issuing role, responsibilities and duties.  Upon that event, the assignee will become the Card Issuer of the Gift Cards and the obligor on the Gift Cards.  Any such assignment will occur without notice to the card owners.  If the terms and conditions so provide, the assignment will be without recourse to Card Issuer, the assignee will become the sole obligor with respect to the Gift Cards upon the assignment, and CIMI2508 will cease to be an obligor with respect to the Gift Cards.
