These terms and conditions (\u201cTerms\u201d) govern your use of your Discord Gift Card Wallet (\u201cWallet\u201d) and form a binding agreement between Weary Travelers, Inc., the Issuer, and you as the Wallet holder. By establishing or using a Wallet, you agree to these Terms. These terms are in addition to the Terms of Service for a Discord Account which can be found at Discord.com<\/a>.<\/p>\n\n\n\n IMPORTANT NOTE: The section titled \u201cSettling disputes\u201d contains a mandatory arbitration clause and class-action waiver that applies to all Wallet holders in the United States. Please read it carefully as it may significantly affect your legal rights, including your right to file a lawsuit in court.<\/strong><\/p>\n\n\n\n Your Wallet is issued by Weary Travelers, Inc. (\u201cIssuer\u201d), which is solely responsible for the Wallet and its value. Issuer is a United States company located in Arizona. Your Wallet may be loaded by you with Discord gift cards. The Wallet is a closed-loop prepaid instrument, which means it can only be used to purchase goods and services online at Discord.com through your Discord account. It is not a debit card, credit card, bank-issued card, or deposit account, and is not linked to any deposit account. The balance on your Wallet does not bear interest and is not insured by the FDIC or any government deposit insurer. There are additional terms governing gift cards, which are available at: My Card Terms Discord US Gift Card.<\/a><\/p>\n\n\n\n Issuer is not an affiliate of Discord Inc. Discord Inc. is not the issuer of this Wallet and is not obligated to you in connection with it. Your contractual relationship with respect to the Wallet is with the Issuer. You agree that Weary Travelers, Inc. is the sole obligor to you for the Wallet, and this agreement shall operate, if and to the extent necessary, as a novation to that effect.<\/strong> If the Issuer delegates its obligations to an assignee, that assignee\u2014not the Issuer\u2014will become the sole obligor<\/p>\n\n\n\n Discord Wallets may be established and opened by following the steps outlined in Discord\u2019s Gift Cards Help Center<\/a>. Establishing and using a Wallet requires an active Discord account in good standing. Instructions on creating or managing a Discord account can be found here<\/a>.<\/p>\n\n\n\n To place gift cards in your Wallet follow the steps outlined in Discord\u2019s Gift Cards Help Center<\/a>. After opening your Wallet, gift cards may be added by you to the Wallet at any time subject to the limits specified herein. You may check your balance as provided below. As a general rule, if you do not use Discord\u2019s two factor authentication system, the total balance held in the Wallet at any given time cannot exceed $150 USD in the United States, $175 CAD in Canada, \u00a3100 GBP in the UK, 150\u20ac EUR in the European Union. As a general rule, if you use Discord\u2019s two factor authentication system, the total balance held in the Wallet at any given time cannot exceed $300 USD in the United States, $350 CAD in Canada, \u00a3200 GBP in the UK, 250\u20ac EUR in the European Union except for France, and 150\u20ac in France. These values may change. Additionally, to comply with applicable laws, to mitigate fraud, or to maintain the security of your account, we may choose to place further limits on the amount of funds that can be deposited into or held in a Wallet and may do so without prior notice.<\/p>\n\n\n\n Your Wallet is usable up to its balance to purchase the goods and services of Discord Inc. online at discord.com. It cannot be refunded or redeemed for cash except as required by law. It is subject to the Limitations on Use that are specified below. It is redeemable only up to its available balance. If you desire to use it to make purchases in excess of the balance then you must combine its use with another acceptable form of payment, if available for the selected purchase<\/p>\n\n\n\n Gift Cards purchased in the United States will be purchased in U.S. dollars ($USD) and may be placed in your Wallet. They will be subject to all the Terms stated herein. Gift Cards purchased in Canada will be purchased in Canadian dollars ($CAD) and may be placed in your Wallet. Gift Cards purchased in the United Kingdom will be purchased in British pound sterling (\u00a3GBP) and may be placed in your Wallet. Gift Cards purchased in Germany and France and other European Union countries in the Eurozone will be purchased in euros (\u20acEUR) and may be placed in your Wallet. <\/p>\n\n\n\n Gift Cards purchased in Canada, United Kingdom and the European Union are subject to these Terms; provided, however, that the following clauses shall not apply to such cards: Arbitration to Arbitrate, Class Actions Waiver, and Governing Law<\/p>\n\n\n\n Your Wallet is subject to limitations on use. It cannot be used to:<\/p>\n\n\n\n Your Wallet also cannot be used for illegal transactions or illicit activities. Your Wallet may not be refunded, returned, or redeemed for cash, except as required by applicable law. Where cash redemption is required by law, the Issuer may satisfy that obligation by cash, check, or electronic funds transfer as permitted by law.<\/p>\n\n\n\n Your use of your Wallet to purchase goods or services from Discord is subject to Discord\u2019s applicable terms and policies. Creation of an account, access to and use of Discord, refunds, returns, merchandise credits, and other relevant terms, if any, are governed by Discord\u2019s policies as the seller. You may find those terms and policies at Discord.com<\/a>.<\/p>\n\n\n\n You may not sell, barter, or exchange your Wallet for value.<\/p>\n\n\n\n Your Wallet does not expire and is not subject to fees assessed against its balance. However, your Wallet may be subject to U.S. state or territorial unclaimed property (escheat) laws. For information about unclaimed property, visit www.unclaimed.org. If your Wallet balance is escheated, contact us at customerservice@cimicard.com or 888.363.9029.<\/p>\n\n\n\n You may check your Wallet balance by visiting your Discord account user settings. More information is available here<\/a>.<\/p>\n\n\n\n Safeguard and treat your Wallet and its numbers as if they were cash. You are responsible for the security of your Discord account and for all transactions on your Wallet, whether or not authorized by you. Lost or stolen funds will not be replaced or replenished. Further, Wallets used or accessed without authorization will not be replaced or replenished.<\/p>\n\n\n\n You are responsible for all transactions associated with your Wallet. Do not share your Wallet information or any Discord account information with others. The Issuer reserves the right to block, freeze, or void a Wallet\u2014without refund\u2014if it suspects abuse, fraud, or unauthorized activity, or if the Wallet or its balance was obtained by theft or other unauthorized means. The Issuer may also apply Wallet balances to offset amounts owed to card companies, networks, or issuers in the event that lost or stolen payment instruments are used to purchase or load the Wallet.<\/p>\n\n\n\n Access to and use of your Wallet requires an active Discord account in good standing. Loss of access to your Discord account for any reason (including but not limited to lost credentials, failing to secure your account, deleting your account, account suspension or termination by Discord, or for any other specified reason) may result in the loss of access to your Wallet and any balance contained within. Discord account access and termination of access are further described in Discord\u2019s Terms of Service<\/a>. If your access is suspended or terminated based on a violation of Discord\u2019s Terms of Service<\/a>, Community Guidelines<\/a>, or other terms and policies, you will not be entitled to a refund or transfer of any balance contained in your Wallet.<\/strong><\/p>\n\n\n\n ISSUER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO A WALLET. IF YOUR WALLET IS NON-FUNCTIONAL DUE TO A SYSTEM ERROR, YOUR SOLE REMEDY IS REPLACEMENT OF THAT WALLET. UNLESS PROHIBITED BY LAW, ISSUER AND YOU AGREE TO LIMIT CLAIMS FOR DAMAGES TO DIRECT ACTUAL DAMAGES ONLY, AND NEITHER PARTY WILL SEEK INDIRECT, SPECIAL, CONSEQUENTIAL, TREBLE, OR PUNITIVE DAMAGES FROM THE OTHER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSIONS OF CERTAIN DAMAGES. IF THOSE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE MAY NOT APPLY.<\/p>\n\n\n\n IMPORTANT: This section requires individual arbitration of disputes and contains a class-action waiver. Please read it carefully.<\/strong><\/p>\n\n\n\n Informal resolution<\/span>. Before starting any arbitration, the Issuer and you agree to try to resolve any dispute informally, which includes any and all claims or disputes regarding Issuer, the Wallet, and\/or the Terms including claims arising under applicable consumer protection laws or other statutory claims (each a \u201cClaim\u201d). Send a Dispute Notice to disputeresolution@cimicard.com with: (1) your name, phone number, and email address; and (2) a description of the dispute and how you\u2019d like it resolved. The Issuer has 90 days to investigate. Either party may request a settlement conference; both must participate individually. The statute of limitations will be tolled through the earlier of 90 days or completion of a settlement conference (the \u201cInformal Resolution Period\u201d). Arbitration cannot begin until the Informal Resolution Period has ended.<\/p>\n\n\n\n Agreement to arbitrate<\/span>. If informal resolution doesn\u2019t resolve the dispute, the Issuer and you agree to resolve all Claims through final, binding, individual arbitration\u2014not in court. This is the exclusive method for resolving Claims, except as described under Exceptions below. This Agreement to Arbitrate applies to Gift Cards that are purchased in the United States and placed into your Wallet. This Agreement to Arbitrate does not apply to Gift Cards that are purchased in Canada, United Kingdom or the European Union and that are placed in this Wallet<\/strong>.<\/p>\n\n\n\n Arbitration governing rules<\/span>. The arbitration will be governed by the Federal Arbitration Act (\u201cFAA\u201d), 9 U.S.C. \u00a7\u00a7 1\u201316. It will be administered by JAMS before a single arbitrator under JAMS\u2019s Streamlined Rules (or Comprehensive Rules if Streamlined don\u2019t apply). See www.jamsadr.com<\/a>.<\/p>\n\n\n\n Arbitration location<\/span>. The arbitration will be at a location determined by JAMS that is reasonably convenient for you, or at a mutually agreed location.<\/p>\n\n\n\n Arbitrator\u2019s authority<\/span>. The arbitrator will resolve Claims exclusively. A court will handle: (a) validity challenges to this agreement; (b) motions to compel arbitration; (c) jurisdictional disputes; and (d) arbitrability questions. The arbitrator will apply the FAA and applicable statutes of limitations, will honor privileges, may grant discovery as appropriate, and cannot award indirect, consequential, special, punitive, or multiplied damages.<\/p>\n\n\n\n Arbitration Exceptions<\/span>. You may bring: (a) individual claims in small claims court; (b) individual actions seeking non-monetary injunctive relief; (c) actions to determine enforceability of this agreement; (d) actions to determine scope of arbitrator\u2019s authority.<\/p>\n\n\n\n Arbitration Fees<\/span>. Arbitration fees will be governed by JAMS\u2019s rules and fee schedules.<\/p>\n\n\n\n Class action waiver<\/span>. The Issuer and you agree to bring and resolve Claims only on an individual basis. You waive any right to participate in any class action, collective proceeding, representative case, or consolidated action\u2014in court or arbitration. No arbitrator may combine individual claims, order class-wide notice, or arbitrate any representative proceeding. This Class Action Waiver applies to Gift Cards that are purchased in the United States and placed into your Wallet. This Class Action Waiver does not apply to Gift Cards that are purchased in Canada, United Kingdom or the European Union and that are placed in this Wallet.<\/p>\n\n\n\n Except as provided in the arbitration section, these Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. The FAA governs all issues of arbitration and arbitrability.<\/p>\n\n\n\n The Issuer may modify these Terms at any time for the following limited purposes: (a) updating redemption limitations; (b) defining changes to the limitations on use of the Wallet; (c) describing what happens if the Wallet program is terminated; (d) clarifying existing terms; (e) updating links and other factual information; (f) implementing changes in the limits placed on the amount of balance values permitted in the Wallet; (g) implementing changes regarding currencies, (h) implementing other good-faith changes, including changes made for legal or regulatory reasons; or (i) to prevent abuse on or of the Wallet program. Changes under (f) may not add an expiration date, impose new fees, modify the arbitration agreement, or modify this section. Changes will be posted at the Wallet Holder Notices<\/a> tab. The most current version supersedes all prior versions.<\/p>\n\n\n\n If any provision of these Terms is found to be unenforceable, void, or voidable, the remaining provisions remain in full force and effect.<\/p>\n\n\n\n The Wallet program may be terminated in certain circumstances, including: (a) Discord ceasing operations; (b) applicable law or regulation requiring termination; (c) a mutual business decision by the Issuer and Discord to end the program; or (d) force majeure events such as pandemics, sabotage, terrorism, civil unrest, or acts of God. If the program is terminated, the Issuer will provide notice to Wallet holders as described in these Terms.<\/p>\n\n\n\n The Issuer or its subcontractors may collect Wallet holder names and addresses for Wallet delivery and other purposes described in the Issuer\u2019s Privacy Policy. The Issuer does not retain that information beyond the time needed for the purpose collected. To the extent permitted by applicable law, the Issuer may provide notices, disclosures, and amendments electronically, including by posting to at the Wallet Holder Notices<\/a> tab.<\/p>\n\n\n\n For questions about your Wallet, contact the Issuer at:<\/p>\n\n\n\n Email: customerservice@cimicard.com The Issuer or its subcontractors may collect personal information and data to deliver Wallets and administer the Wallet program. That information may be transferred to and processed in the United States. By opening, accepting, or using a Wallet, you consent to this collection and use.
