Card Issuer is not an affiliate of Discord Inc. Discord Inc. is not the issuer of this Gift Card and is not obligated to you in connection with it. Your contractual relationship for the Gift Card is with the Card Issuer. GOVERNING LAW <\/strong><\/h3>\n\n\n\nExcept as provided in the arbitration section, these Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. CHANGES TO THESE TERMS <\/b><\/h3>\n\n\n\nThe Card Issuer may modify these Terms at any time for the following limited purposes: (a) updating redemption limitations; (b) defining changes to limitations on use; (c) describing what happens if the Gift Card program is terminated; (d) clarifying existing terms; (e) updating links and other factual information; or (f) implementing other good-faith changes. Changes under (f) may not add an expiration date, impose new fees, modify the arbitration agreement, or modify this section. Changes will be posted here under the Cardholder Notices here<\/a>. The most current version supersedes all prior versions.<\/p>\n\n\n\n<\/a>17. SEVERABILITY <\/b><\/h3>\n\n\n\nIf any provision of these Terms is found to be unenforceable, void, or voidable, the remaining provisions remain in full force and effect.<\/p>\n\n\n\n
18. PROGRAM TERMINATION<\/b><\/strong><\/h3>\n\n\n\nThe Gift Card program may be terminated in certain circumstances, including: (a) Discord ceasing operations; (b) applicable law or regulation requiring termination; (c) a mutual business decision by the Card Issuer and Discord to end the program; or (d) force majeure events such as pandemics, sabotage, terrorism, civil unrest, or acts of God. NOTICES TO CARDHOLDERS <\/b><\/strong><\/h3>\n\n\n\nThe Card Issuer or its subcontractors may collect cardholder names and addresses for Gift Card delivery and other purposes described in the Card Issuer\u2019s Privacy Policy. The Card Issuer does not retain that information beyond the time needed for the purpose collected. Tampering is also a risk. IMPORTANT: This section requires individual arbitration of disputes and contains a class-action waiver. Please read it carefully.<\/strong><\/p>\n\n\n\n Informal resolution<\/span>. Before starting any arbitration, the Card Issuer and you agree to try to resolve any dispute informally, which includes any and all claims or disputes regarding Card Issuer, the Gift Card, and\/or the Terms including claims arising under applicable consumer protection laws or other statutory claims (each a \u201cClaim\u201d). Send a Dispute Notice to disputeresolution@cimicard.com with: (1) your name, phone number, and email address; and (2) a description of the dispute and how you\u2019d like it resolved. The Card Issuer has 90 days to investigate. Either party may request a settlement conference; both must participate individually. The statute of limitations will be tolled through the earlier of 90 days or completion of a settlement conference (the \u201cInformal Resolution Period\u201d). Arbitration cannot begin until the Informal Resolution Period has ended.<\/p>\n\n\n\n Agreement to arbitrate<\/span>. If informal resolution doesn\u2019t resolve the dispute, the Card Issuer and you agree to resolve all Claims through final, binding, individual arbitration\u2014not in court. This is the exclusive method for resolving Claims, except as described under Exceptions below.<\/p>\n\n\n\n Arbitration governing rules<\/span>. The arbitration will be governed by the Federal Arbitration Act (\u201cFAA\u201d), 9 U.S.C. \u00a7\u00a7 1\u201316. It will be administered by JAMS before a single arbitrator under JAMS\u2019s Streamlined Rules (or Comprehensive Rules if Streamlined don\u2019t apply). The arbitration will be at a location determined by JAMS that is reasonably convenient for you, or at a mutually agreed location.<\/p>\n\n\n\n Arbitrator\u2019s authority<\/span>. A court will handle: (a) validity challenges to this agreement; (b) motions to compel arbitration; (c) jurisdictional disputes; and (d) arbitrability questions. The arbitrator will apply the FAA and applicable statutes of limitations, will honor privileges, may grant discovery as appropriate, and cannot award indirect, consequential, special, punitive, or multiplied damages.<\/p>\n\n\n\n Arbitration Exceptions<\/span>. You may bring: (a) individual claims in small claims court; (b) individual actions seeking non-monetary injunctive relief; (c) actions to determine enforceability of this agreement; (d) actions to determine scope of arbitrator\u2019s authority.<\/p>\n\n\n\n Arbitration Fees<\/span>. Arbitration fees will be governed by JAMS\u2019s rules and fee schedules.<\/p>\n\n\n\n Class action waiver<\/span>. The Card Issuer and you agree to bring and resolve Claims only on an individual basis. You waive any right to participate in any class action, collective proceeding, representative case, or consolidated action\u2014in court or arbitration. No arbitrator may combine individual claims, order class-wide notice, or arbitrate any representative proceeding.<\/p>\n\n\n\n Except as provided in the arbitration section, these Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. The FAA governs all issues of arbitration and arbitrability.<\/p>\n\n\n\n The Card Issuer may modify these Terms at any time for the following limited purposes: (a) updating redemption limitations; (b) defining changes to limitations on use; (c) describing what happens if the Gift Card program is terminated; (d) clarifying existing terms; (e) updating links and other factual information; or (f) implementing other good-faith changes. Changes under (f) may not add an expiration date, impose new fees, modify the arbitration agreement, or modify this section. Changes will be posted here under the Cardholder Notices here<\/a>.
