Discord Gift Card Full Terms and Conditions

Thank you for purchasing a Discord Gift Card!
These terms and conditions (“Terms”) govern your use of your Discord Gift Card (“Gift Card”) and form a binding agreement between Weary Travelers, Inc., the Card Issuer, and you as the cardholder. By purchasing, accepting, or using a Gift Card, you agree to these Terms.
IMPORTANT NOTE: The section titled “Settling disputes” contains a mandatory arbitration clause and class-action waiver that applies to all cardholders. Please read it carefully as it may significantly affect your legal rights, including your right to file a lawsuit in court.
1. ABOUT YOUR GIFT CARD
Your Gift Card is issued by Weary Travelers, Inc. (“Card Issuer”), which is solely responsible for the Gift Card and its value. Card Issuer is not an affiliate of Discord Inc. Discord Inc. is not the issuer of this Gift Card and is not obligated to you in connection with it. Your contractual relationship for the Gift Card is with the Card Issuer. You agree that Weary Travelers, Inc. is the sole obligor to you for the Gift Card, and this agreement shall operate, if and to the extent necessary, as a novation to that effect. If the Card Issuer delegates its obligations to an assignee, that assignee—not the Card Issuer—will become the sole obligor. Your Gift Card is a closed-loop prepaid instrument, which means it can only be used to purchase goods and services online on Discord through your Discord account. It is not a debit card, credit card, bank-issued card, or deposit account, and is not linked to any deposit account. The balance on your Gift Card does not bear interest and is not insured by the FDIC or any government deposit insurer.
2. PURCHASING A GIFT CARD
Gift Cards may be purchased at the participating retailers, described here(each a “Purchase Site”).
Online purchases are governed by the purchase and delivery terms on the relevant Purchase Site, which are separate from these Terms. Gift Cards purchased in the United States are denominated in U.S. dollars. Unless specified otherwise at purchase, a Gift Card may be loaded with a minimum of $15 and a maximum of $150. No individual may purchase Gift Cards totaling more than $10,000 in a single day. A Gift Card is not valid unless properly acquired and activated. Gift Cards obtained from unauthorized sellers or resellers, including internet auction sites, are not valid. Your Gift Card may not be reloaded.
3. FRAUD AWARENESS
Gift cards are frequently targeted by scammers. Don’t purchase a Gift Card unless you’re buying it as a gift or for your own use—and never buy one to make a payment at someone else’s direction. For more about gift card fraud, visit stopgiftcardscams.com.
Tampering is also a risk. Fraudsters can remove cards from retail displays, steal the card numbers and PIN, reseal the packaging, and return the card to the rack—then drain the balance once it’s activated. Before purchasing, inspect the card and its packaging carefully. If anything looks removed, ripped, damaged, or tampered with, don’t buy it.
As a part of our consumer fraud prevention program, Card Issuer asks that consumers take a moment to review Card Issuer’s fraud notices prior to purchase. You do not want to be caught in a fraud scam. To the extent permitted by law, the Card Issuer is not responsible for third-party fraud or unauthorized conduct related to any Gift Card.
4. REDEEMING YOUR GIFT CARD
Your Gift Card can only be used to purchase goods and services online at Discord through your Discord account. To redeem your Gift Card, add it to your Discord account. For instructions on how to do that, visit Redemption Guide.
5. YOUR DISCORD ACCOUNT
Using your Gift Card requires internet access and a Discord account. Instructions on creating or managing a Discord account can be found here. Purchases made through your Discord account are subject to Discord’s Terms of Service and Privacy Policy.
6. LIMITATIONS ON USE
Your Gift Card is subject to limitations on use. It cannot be used to:
- Purchase another Gift Card;
- Pay for previously purchased merchandise;
- Make payments toward any credit account; and
- Make purchases anywhere other than online at Discord through your Discord account.
Your Gift Card also cannot be used for illegal transactions or illicit activities. Your Gift Card may not be refunded, returned, or redeemed for cash, except as required by applicable law. It is not reloadable. Where cash redemption is required by law, the Card Issuer may satisfy that obligation by cash, check, or electronic funds transfer as permitted by law.
7. GOODS AND SERVICES PURCHASED WITH YOUR GIFT CARD
Your use of your Gift Card to purchase goods or services from Discord is subject to Discord’s applicable terms and policies. Creation of an account, access to and use of Discord, refunds, returns, merchandise credits, and other relevant terms, if any, are governed by Discord’s policies as the seller. 8. RESALE
You may not sell, barter, or exchange your Gift Card for value. You may give it to another person as a gift with no monetary consideration, which is its intended purpose.
9. NO EXPIRATION AND NO FEES
Your Gift Card does not expire and is not subject to fees assessed against its balance. However, your Gift Card may be subject to state or territorial unclaimed property (escheat) laws. 11. RISK OF LOSS, DAMAGE, THEFT OR UNAUTHORIZED USE
Title to the Gift Card and risk of loss passes to the Gift Card purchaser when a Gift Card is delivered. With respect to physical Gift Cards or digital Gift Cards purchased at a physical location (as opposed to online) delivery occurs upon delivery of the physical Gift Card or digital Gift Card to the purchaser. With respect to an online purchase of a physical Gift Card, delivery occurs upon delivery of the physical Gift Card to the purchaser’s designated recipient. With respect to an online purchase of and the electronic delivery of a digital Gift Card, delivery occurs when the digital Gift Card is clicked by the sender as sent. Although a Gift Card is not cash, you should safeguard your Gift Card like you do cash. You are responsible for the transactions using your Gift Card, whether authorized or unauthorized. Your Gift Card will not be replaced or replenished if lost, stolen, damaged or used without authorization.
12. FRAUD AND UNAUTHORIZED TRANSACTIONS
You are responsible for all transactions associated with your Gift Card. Don’t share your Gift Card information with others. The Card Issuer reserves the right to block, freeze, or void a Gift Card—without refund—if it suspects abuse, fraud, or unauthorized activity, or if the Gift Card or its balance was obtained by theft or other unauthorized means. The Card Issuer may also apply Gift Card balances to offset amounts owed to card companies, networks, or issuers with respect to lost or stolen payment instruments used to purchase or load the Gift Card.
13. LIMITATION OF LIABILITY
CARD ISSUER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY GIFT CARD INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD IS NON-FUNCTIONAL, DUE TO A SYSTEM ERROR, YOUR SOLE REMEDY SHALL BE THE REPLACEMENT OF THAT GIFT CARD. UNLESS PROHIBITED BY LAW, CARD ISSUER AND YOU AGREE TO LIMIT CLAIMS FOR DAMAGES OR OTHER MONETARY RELIEF AGAINST EACH OTHER TO DIRECT ACTUAL DAMAGES. AND CARD ISSUER AND YOU WILL NOT SEEK ANY INDIRECT, SPECIAL, CONSEQUENTIAL, TREBLE, OR PUNITIVE DAMAGES FROM THE OTHER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
14. SETTLING DISPUTES
IMPORTANT: This section requires individual arbitration of disputes and contains a class-action waiver. Please read it carefully.
Informal resolution. Before starting any arbitration, the Card Issuer and you agree to try to resolve any dispute informally, which includes any and all claims or disputes regarding Card Issuer, the Gift Card, and/or the Terms including claims arising under applicable consumer protection laws or other statutory claims (each a “Claim”). Send a Dispute Notice to disputeresolution@cimicard.com with: (1) your name, phone number, and email address; and (2) a description of the dispute and how you’d like it resolved. The Card Issuer has 90 days to investigate. Either party may request a settlement conference; both must participate individually. The statute of limitations will be tolled through the earlier of 90 days or completion of a settlement conference (the “Informal Resolution Period”). Arbitration cannot begin until the Informal Resolution Period has ended.
Agreement to arbitrate. If informal resolution doesn’t resolve the dispute, the Card Issuer and you agree to resolve all Claims through final, binding, individual arbitration—not in court. This is the exclusive method for resolving Claims, except as described under Exceptions below.
Arbitration governing rules. The arbitration will be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1–16. It will be administered by JAMS before a single arbitrator under JAMS’s Streamlined Rules (or Comprehensive Rules if Streamlined don’t apply). See www.jamsadr.com.
Arbitration location. The arbitration will be at a location determined by JAMS that is reasonably convenient for you, or at a mutually agreed location.
Arbitrator’s authority. The arbitrator will resolve Claims exclusively. A court will handle: (a) validity challenges to this agreement; (b) motions to compel arbitration; (c) jurisdictional disputes; and (d) arbitrability questions. The arbitrator will apply the FAA and applicable statutes of limitations, will honor privileges, may grant discovery as appropriate, and cannot award indirect, consequential, special, punitive, or multiplied damages.
Arbitration Exceptions. You may bring: (a) individual claims in small claims court; (b) individual actions seeking non-monetary injunctive relief; (c) actions to determine enforceability of this agreement; (d) actions to determine scope of arbitrator’s authority.
Arbitration Fees. Arbitration fees will be governed by JAMS’s rules and fee schedules.
Class action waiver. The Card Issuer and you agree to bring and resolve Claims only on an individual basis. You waive any right to participate in any class action, collective proceeding, representative case, or consolidated action—in court or arbitration. No arbitrator may combine individual claims, order class-wide notice, or arbitrate any representative proceeding.
15. GOVERNING LAW
Except as provided in the arbitration section, these Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law principles. The FAA governs all issues of arbitration and arbitrability.
16. CHANGES TO THESE TERMS
The Card Issuer may modify these Terms at any time for the following limited purposes: (a) updating redemption limitations; (b) defining changes to limitations on use; (c) describing what happens if the Gift Card program is terminated; (d) clarifying existing terms; (e) updating links and other factual information; or (f) implementing other good-faith changes. Changes under (f) may not add an expiration date, impose new fees, modify the arbitration agreement, or modify this section. Changes will be posted here under the Cardholder Notices here. The most current version supersedes all prior versions.
17. SEVERABILITY
If any provision of these Terms is found to be unenforceable, void, or voidable, the remaining provisions remain in full force and effect.
18. PROGRAM TERMINATION
The Gift Card program may be terminated in certain circumstances, including: (a) Discord ceasing operations; (b) applicable law or regulation requiring termination; (c) a mutual business decision by the Card Issuer and Discord to end the program; or (d) force majeure events such as pandemics, sabotage, terrorism, civil unrest, or acts of God. If the program is terminated, the Card Issuer will provide notice to cardholders as described in these Terms
19. NOTICES TO CARDHOLDERS
The Card Issuer or its subcontractors may collect cardholder names and addresses for Gift Card delivery and other purposes described in the Card Issuer’s Privacy Policy. The Card Issuer does not retain that information beyond the time needed for the purpose collected. To the extent permitted by applicable law, the Card Issuer may provide notices, disclosures, and amendments electronically, including by posting to the Cardholder Notices page here.

21. PRIVACY
The Card Issuer or its subcontractors collect personal information and data to deliver Gift Cards and administer the Gift Card program. That information may be transferred to and processed in the United States. By purchasing, accepting, or using a Gift Card, you consent to this collection and use. The Card Issuer’s collection and use of personal information is governed by the Card Issuer’s Privacy Policy.
